Art. 1 - General provisions
By navigating in this area, the user accesses www.arteolfatto.com, accessible via the URL: www.arteolfatto.com . Browsing and transmitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site indicated therein.
These General Terms and Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by

The user is obliged, before accessing the products provided by the site, to read these General Terms and Conditions of Sale, which are generally and unequivocally accepted at the time of purchase.
The user is invited to download and print a copy of the purchase form and these General Terms and Conditions of Sale, the terms of which www.arteolfatto.com reserves the right to modify unilaterally and without prior notice.
Art. 2 - Object
These General Terms and Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on www.arteolfatto.com. They do not, however, govern the provision of services or the sale of products by parties other than the seller who are present on the same site via links, banners or other hypertext links.
Before placing orders and purchasing products and services from parties other than the seller, we suggest that you check their terms and conditions of sale.
Art. 3 - Conclusion of the contract
In order to conclude the purchase contract, it will be necessary to complete the form in electronic format and send it by following the relevant instructions.
It contains a reference to the General Terms and Conditions of Sale, the images of each product and its price, the means of payment that can be used, the method of delivery of the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal; methods and times for returning the purchased products.
Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data.
The contract is concluded when the seller receives the form completed by the user, after checking that the data contained therein is correct.
The buyer will be obliged to pay the price from the moment the online order process is completed. This will be done by clicking on the "ORDER WITH PAYMENT OBLIGATION" button at the end of the guided procedure.
Once the contract is concluded, the seller takes charge of the order for processing.
Article 4 - Registered users
In completing the registration procedures, the user undertakes to follow the instructions on the site and to provide his personal data correctly and truthfully.
Confirmation shall in any case exempt www.arteolfatto.com from any liability regarding the data provided by the user. The user undertakes to promptly inform www.arteolfatto.com of any changes to their data communicated at any time.
If the user then communicates inaccurate or incomplete data or in the event of a dispute by the parties concerned regarding payments made, www.arteolfatto.com shall be entitled not to activate or suspend the service until such shortcomings have been rectified.
Upon the user's first request for activation of a profile, www.arteolfatto.com shall assign a user name and password. The user acknowledges that these identifiers constitute the validation system for access to the Services and are the only means for identifying the user and attributing to him/her the acts performed through such access, which shall be binding on him/her.
The user undertakes to maintain the confidentiality of his access data and to keep them carefully, without temporarily handing them over to third parties.
Art. 5 - Availability of Products
Product availability refers to the actual availability at the time the purchaser places the order. However, this availability is purely indicative since, due to the simultaneous presence of several users on the site, products may be sold to other customers before the order is confirmed.
Even after the order confirmation e-mail has been sent, partial or total unavailability of the goods may occur. In such a case, the order will automatically be rectified by deleting the unavailable product and the purchaser will be informed immediately by e-mail.
If the purchaser requests cancellation of the order, thereby terminating the contract, www.arteolfatto.com shall refund the amount paid within 30 days of the date on which it became aware of the purchaser's decision to terminate the contract.

Art. 7 - Payment methods and prices
Our payment is secure with SSL encryption.
Payment methods:
Debit and credit cards: After creating an order, you will be redirected to the bank's payment gateway, where you can enter the necessary payment details. Please note that the employees of www.arteolfatto.com do not have access to the customer's card data, as everything is handled exclusively by the bank.
Bank transfer: Once the order has been created and completed, the customer will be provided with all information regarding the account number and random payment code. This payment method is considered an advance payment at our bank. It is important to enter the random payment code correctly in order to associate the payment with the customer's order. If you choose this payment method, please note that your order will only be shipped after receipt of payment, which may take 1-2 days longer than with immediate payment methods.
Scalapay: If you purchase with Scalapay, you will receive your order immediately and can pay in 3 instalments. Please note that the instalments will be assigned to Invremento SPV S.r.l., its related parties and their assignees, and you authorise this assignment.
Art. 8 - Delivery
Products are shipped by express courier selected by the customer during the purchase phase.
Transport costs vary depending on the weight and destination of the shipment. The customer can select the mode that best suits his or her needs via the appropriate menu during the purchase phase. The total amount of shipping costs will be visible before confirming the purchase.
Shipping costs include shipping charges and any additional costs related to insurance.
Delivery time depends on product availability and destination. During the purchasing process, an approximate indication of the delivery time will be provided. Please note that these times are purely indicative and not binding.
Art. 9 - Right of withdrawal
Pursuant to Article 52 of the Consumer Code, the purchaser has the right to withdraw from the contract, without having to give any reasons, within 14 days from the date of receipt of the products.
To exercise the right of withdrawal, the purchaser must inform www.arteolfatto.com of his or her decision to withdraw by means of an explicit statement sent by post, fax or e-mail. The withdrawal form attached to these General Terms and Conditions of Sale may be used, although it is not mandatory.
In the event of withdrawal, the buyer must return the products to the seller, undamaged and in their original packaging, within 14 days from the date on which he communicated his decision to withdraw. The costs of returning the products shall be borne by the buyer.
The seller will refund the amount paid by the buyer, including standard delivery charges, within 14 days from the date on which the buyer was informed of the decision to withdraw. The refund will be made using the same means of payment used by the buyer for the purchase, unless otherwise agreed between the parties.

Art. 11 - Applicable law and jurisdiction
These General Terms and Conditions of Sale are governed by Italian law.
For any dispute concerning the interpretation, validity and/or execution of these General Terms and Conditions of Sale, the competent court shall be the court of the place of residence or domicile of the purchaser, if located in Italian territory. In case of residence or domicile abroad, the Court of Milan shall have jurisdiction.
Art. 12 - Processing of personal data
By using the website www.arteolfatto.com , the user authorises the processing of his/her personal data. This information is also valid pursuant to Art. 13 of Legislative Decree no. 196/2003, Personal Data Protection Code, and Article 13 of EU Regulation no. 2016/679 on the protection of individuals with regard to the processing of personal data and the free movement of such data.

The data provided by the user regarding purchase orders, payments, IP address and other communicated information will be processed in order to execute the purchase order, manage payments, communicate with the user regarding the activities and services of the site, provide commercial offers from affiliated companies and business partners.
The provision of data and consent to their processing for the above purposes are necessary to conclude and fulfil the purchase contract. Refusal to provide such data or to give consent to their processing may make it impossible for the user to make purchases on the site.
Users have the right to access, update, rectify or supplement their personal data, as well as to request their deletion, transformation into anonymous form or the blocking of data processed in violation of the law. Art. 13 - Severability clause
Should any of the clauses of these General Terms and Conditions of Sale be null and void for any reason whatsoever, this shall not affect the validity and application of the other provisions contained in the document.

Art. 15 - Applicable law and competent court
These General Conditions of Sale are subject to Italian law. For any dispute concerning these conditions, the court of the place of residence or domicile of the purchaser, if located in Italy, shall have jurisdiction. If the purchaser has his residence or domicile abroad, the Court of Milan shall have jurisdiction.
Art. 16 - Changes to the General Terms and Conditions of Sale
LUXURY PERFUMES S.R.L. reserves the right to make changes to these General Terms and Conditions of Sale at any time, without prior notice and with immediate effect. Changes shall be published on the website www.arteolfatto.com and shall apply to orders placed after their publication. The user is invited to periodically check the General Terms and Conditions of Sale in order to be updated on any changes.
Art. 17 - Intellectual Property
All content on the website www.arteolfatto.com , including images, text, logos, graphics and any other elements, are the exclusive property of LUXURY PERFUMES S.R.L. or the respective rights holders. Unauthorised reproduction, distribution, modification or use of such content is prohibited without the prior written consent of the owner.
Art. 18 - Force majeure
LUXURY PERFUMES S.R.L. shall not be liable for any delays or failures in the performance of its obligations under these General Terms and Conditions of Sale caused by events of force majeure, including but not limited to strikes, natural disasters, technical failures or other causes beyond its reasonable control.
Art. 19 - Severability
Should any provision of these General Terms and Conditions of Sale be deemed invalid or ineffective under applicable law, that provision will be deleted without affecting the validity and enforceability of the remaining provisions.
Art. 20 - Language
These General Terms and Conditions of Sale are drawn up in Italian. In the event of any discrepancy or interpretation between the Italian version and the translations into other languages, the Italian version shall prevail.
